Landmark judgment on retrospective legislation

James Ramsden appeared in a landmark claim against HMRC concerning the compatibility of retrospective UK legislation with Article 1, Protocol 1 of the European Convention on Human Rights.

Judgment was handed down on 28th January 2010 and a link to the Judgment is set out below.

The decision, which will be appealed to the Court of Appeal, has far reaching implications for legislation said to have retrospective effect and will be of interest to constitutional lawyers and professional advisors in the legal, accountancy and financial services industry.
