Court of Appeal rules on privacy claim by J.K. Rowling’s infant son
By a judgment handed down on 7 May 2008 (Murray v Big Pictures (UK) Ltd [2008] EWCA Civ 446) the Court of Appeal (Sir Anthony Clarke MR, Laws and Thomas LJJ) allowed the appeal of David Murray, the infant son of the author J.K.Rowling and her husband Dr Neil Murray, from the dismissal by Patten J of his claims against a photographic agency for misuse of private information and under the Data Protection Act 1998.

MDU wins important data protection case
Following a three day hearing in December 2006, on 28 March 2007 the Court of Appeal handed down judgment on Mr Johnson’s appeal against the decision of Rimer J of March 2006 (whereby his claim was dismissed), and on the cross-appeal of the Medical Defence Union (“the MDU”) which sought to uphold that decision on additional grounds. The appeal was dismissed and the cross-appeal was allowed.

Challenge to new Rule concerning the supply of Court documents
The Law Society obtained an urgent injunction from Irwin J on 29 September 2006 to prevent changes to CPR 5.4 that come into force on 2 October 2006 from being applied to statements of case filed at Court before that date. The changes reverse the previous CPR 5.4 by making it the default position that statements of case will be released unless the Court orders that they should not be.
